Terms of Use
1. Definitions
For the purposes of these Terms:
- "Provider": Sebastian Ehrhardt, operator of the Service.
- "Customer": the natural or legal person who contracts the Service with the Provider (typically the owner of a hospitality venue).
- "Service": the Avisa web application and related features provided by the Provider.
- "Authorised Users": the Customer's personnel whom the Customer authorises to use the Service on its behalf (e.g., via an access PIN).
2. Acceptance
Use of the Service implies full acceptance, by the Customer and its Authorised Users, of these Terms of Use, the Legal Notice and the Privacy Policy.
3. The Service
The Service is a web application for order management and waiter-call notifications at hospitality venues. The Service does not process payments.
4. Free trial
The Service may be offered as a free trial for a limited period. To continue using the Service after the free trial, the Customer must actively opt-in for a paid plan. During the trial, the Provider assumes no availability obligation and no service-level commitment.
5. Customer obligations
The Customer undertakes to:
- Provide accurate information when signing up.
- Inform its Authorised Users about the use of the Service and comply with its own labour-law and data-protection obligations.
- Keep access credentials confidential.
6. Limitation of liability
The Service is provided "as is" and "as available". To the maximum extent permitted by law, the Provider shall not be liable for:
- Direct, indirect, incidental or consequential damages arising from the use of, or inability to use, the Service.
- Loss of data, service interruptions, network failures or incompatibility with the Customer's hardware or software.
- Business decisions made by the Customer on the basis of information provided by the Service.
This limitation does not exclude liability for intentional misconduct or gross negligence, nor the mandatory rights granted to consumers by applicable law.
7. Suspension and termination
The Provider may suspend or terminate access to the Service in case of misuse, non-payment or breach of these Terms. The Customer may cancel the account at any time by emailing contact@seb-service.com.
8. Changes
These Terms may be updated. The current version is the one published on this page.
9. Applicable law and jurisdiction
Spanish law applies. The courts of the Provider's domicile have jurisdiction.
